1) Acceptance of Terms

By creating an account, accessing, or using the Kidz Community mobile application, website, and community features (collectively, the “Service”), you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use the Service.

2) Who May Use the Service

  • You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
  • The Service is not directed to children under 13, and we do not knowingly allow them to create accounts. If you believe a child under 13 has provided personal data, contact us so we can take appropriate steps.

3) Accounts & Security

  • You are responsible for safeguarding your login credentials and for all activity on your account. Notify us immediately of unauthorized use.
  • We may reclaim usernames on behalf of businesses or individuals that hold legal rights to them.

4) Community Conduct

This is a supportive, family‑friendly community. You agree not to:

  • Post or share content that is unlawful, harmful, harassing, defamatory, hateful, discriminatory, sexually explicit, violent, or otherwise inappropriate.
  • Bully, threaten, dox, or impersonate others.
  • Post medical advice or claims presented as fact without appropriate qualifications or citations.
  • Post content that infringes intellectual property or privacy rights.
  • Upload malware, attempt to scrape or reverse engineer, or interfere with the Service’s operation.
  • Circumvent moderation tools or create multiple accounts to evade enforcement.

We reserve the right to remove content, restrict features, and/or suspend or terminate accounts for violations.

5) User‑Generated Content (UGC)

  • You retain ownership of the content you post (“UGC”). You grant KIDZ THERAPY NETWORKS Inc a worldwide, non‑exclusive, royalty‑free, sublicensable, transferable license to host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your UGC solely to operate, improve, and promote the Service.
  • You represent and warrant you have all rights necessary to grant this license and that your UGC complies with these Terms and applicable law.
  • Reporting/Blocking Tools. The Service provides tools to report and block UGC and users. We may use automated and human moderation.

6) No Sharing or Sale of Personal Information

  • We do not sell or share your personal information for cross‑context behavioral advertising.
  • We collect only the minimum personal information necessary to provide the Service (see Privacy Policy). We do not disclose personal information to third parties except:
    • To service providers acting on our behalf under contractual confidentiality and security obligations;
    • To comply with law, protect safety, or enforce our rights;
    • With your consent.
  • We maintain technical and organizational measures to protect personal data and follow data‑minimization, purpose‑limitation, retention, and deletion practices described in our Privacy Policy.

Important: The Privacy Policy is incorporated into these Terms by reference and explains our data practices in detail, including data collected by the app, device permissions, analytics, crash logs, and how to exercise choices.

7) Health & Safety; No Medical Advice

  • Content in the Service is for educational and informational purposes only and is not medical or professional advice. The Service is not a substitute for diagnosis, treatment, or individualized therapy. Call 911 or local emergency services for emergencies.
  • If you are a professional posting content, you must follow your licensing rules, avoid protected health information, and include appropriate disclaimers. The Service is not a HIPAA‑covered service unless we expressly enter into a Business Associate Agreement with your organization.

8) Virtual Interactions & Community Features

  • The Service may include groups, forums, messaging, live sessions, and events. You understand that interactions may be recorded or moderated to maintain safety and quality. Do not share private or sensitive information.

9) App Permissions & Device Access

  • Certain features may request access to device functions (e.g., camera, photos, microphone, notifications). You can manage permissions in your device settings. Some features may not work without permission.

10) In‑App Purchases, Subscriptions & Refunds

  • Some features may require payments processed by Apple App Store or Google Play. All purchases are subject to the applicable store’s terms and policies.
  • Subscriptions renew automatically until canceled. Manage or cancel via your platform account settings. Access continues through the paid period; fees are non‑refundable except as required by law or the platform’s policies.

11) Changes to the Service

We may change, suspend, or discontinue any part of the Service. We may update these Terms by posting the revised version with a new “Last Updated” date. Continued use constitutes acceptance.

12) Intellectual Property; Feedback

  • The Service (including text, graphics, logos, software) is owned by KIDZ THERAPY NETWORKS Inc and its licensors and is protected by IP laws. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial purposes.
  • If you submit feedback or suggestions, you grant us a license to use them without restriction or compensation.

13) Third‑Party Services

The Service may link to or integrate third‑party websites, SDKs, or services. We are not responsible for their content or practices. Your use is governed by their terms and privacy policies.

14) International Use; Export Controls

You are responsible for complying with local laws. You may not use or export the Service in violation of U.S. export laws and regulations.

15) Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDZ THERAPY NETWORKS Inc AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) ANY CONTENT OR INFORMATION OBTAINED FROM THE SERVICE.

17) Indemnification

You agree to defend, indemnify, and hold harmless KIDZ THERAPY NETWORKS Inc from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

18) Termination

We may suspend or terminate your access at any time for any reason, including violations of these Terms. Upon termination, your license ends and you must stop using the Service. Certain provisions (e.g., IP, disclaimers, limitations of liability, indemnity) survive termination.

19) Governing Law; Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Georgia, US without regard to conflict‑of‑law principles.
  • Informal Resolution: Contact us first to try to resolve disputes informally within 30 days.
  • Arbitration/Class Action Waiver (optional): Except for small claims, disputes will be resolved by binding arbitration on an individual basis; class actions are waived. 

20) Digital Millennium Copyright Act (DMCA)

If you believe content infringes your copyright, send a notice to our designated agent: Include all required information under 17 U.S.C. §512(c)(3).

21) Platform‑Specific Terms

  • Apple App Store. If you downloaded via Apple:
    • These Terms are between you and KIDZ THERAPY NETWORKS Inc, not Apple. Apple is not responsible for the Service or its content.
    • Apple has no obligation to furnish maintenance or support.
    • In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
    • Apple is not responsible for claims, losses, liabilities, damages, costs, or expenses with respect to the Service.
    • You represent that you are not located in a U.S. embargoed country and are not on any U.S. government list of prohibited or restricted parties.
    • Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.
  • Google Play. If you downloaded via Google Play:
    • These Terms are between you and KIDZ THERAPY NETWORKS Inc, not Google. Google is not responsible for the Service or its content.
    • Google has no obligation to furnish maintenance or support.
    • In the event of a failure to conform to any applicable warranty, you may request remedies consistent with Google Play’s refund policies.

22) Families & Youth Safety (If Applicable)

If the Service participates in a family/children program or is likely to be used by minors:

  • We obtain verifiable parental consent where required and provide parental controls.
  • We do not use children’s personal information for behavioral advertising or profiling.
  • We limit notifications and data collection for child users to what is reasonably necessary for the feature they are using and follow strict retention/deletion practices.
